Madrid System

International registrations designating Türkiye

Türkiye is a member of the Madrid System, which now has 117 members covering 133 countries. A designation of Türkiye is examined by TÜRKPATENT like a national application and published in the Official Trademark Bulletin. If it is refused, the holder must respond through a local attorney.

When you need us

  • Ex officio provisional refusal: TÜRKPATENT objects on absolute grounds, for example lack of distinctiveness or an identical earlier mark.
  • Opposition-based refusal: a third party has opposed your designation after its publication in the Turkish bulletin.
  • You want to oppose a Turkish application or another Madrid designation that conflicts with your mark.
  • You need a statement of grant, a recordal (change of owner, licence) or proof of use in Türkiye.

How we handle a provisional refusal

  • We review the refusal notice and the cited marks, and confirm the response deadline.
  • We recommend a strategy: arguments, limitation of goods and services, evidence of use or acquired distinctiveness, or a letter of consent from the earlier owner.
  • We file the response in Turkish with TÜRKPATENT and report the outcome. If the refusal is upheld, we advise on an appeal to the court.

Frequently asked questions

Does the Madrid response have to come from a Turkish attorney?
Yes. Responses to provisional refusals before TÜRKPATENT are filed by a representative registered in Türkiye.
Is the deadline extendable?
Deadlines are strict. Instruct us as soon as you receive the notice from WIPO so that we have time to prepare the arguments and evidence.
